The Law

The law of the land (in England and Wales) in relation to driving with drink or drugs is governed by sections 4, 5, and 7 of the Road Traffic Act 1988.

Section 4 Road Traffic Act 1988 makes it an offence to drive or attempt to drive whilst unfit to do so through drink or drugs. Section 5(1)(a) Road Traffic Act 1988 makes it an offence to drive or attempt to drive on a road or other public place after consuming so much alcohol that the proportion of it in his breath, blood or urine exceeds the prescribed limit. Section 5(1)(b) Road Traffic Act 1988 makes it an offence to be in charge of a motor vehicle on a road or other public after consuming so much alcohol that the proportion of it in his breath, blood or urine exceeds the prescribed limit. Section 7(6) Road Traffic Act 1988 makes it an offence to fail to provide a specimen when required to do so.
